1. Overview

Instructors Office provides AI-powered call handling and administrative support services to business clients.

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.


2. Nature of Services

Our services include, but are not limited to:

- AI-assisted call answering

- Message taking and structured call summaries

- Facilitation of SMS communications (including booking links and feedback requests)

The services are provided as an assistive tool and are not a substitute for independent business judgment or operational oversight.


3. No Guarantee of Outcomes

We make no representation or warranty in relation to:

- Conversion rates or booking outcomes

- Revenue generation or business performance

- The accuracy, completeness, or reliability of AI-generated outputs

Clients are solely responsible for assessing and verifying information before relying upon it.


4. Client Responsibilities

Clients agree to:

- Use the services in compliance with all applicable laws and regulations

- Ensure appropriate disclosures are made to customers (including where AI interaction or call recording is involved)

- Obtain any necessary consents for communications

- Independently verify information where required


5. Acceptable Use

Clients must not use the services to:

- Engage in unlawful, misleading, or deceptive conduct

- Transmit unsolicited or unauthorised communications

- Misrepresent the nature or capabilities of the service

- Infringe upon the rights of any third party


6. Communications and Consent

Clients are responsible for ensuring that all communications conducted through the platform comply with applicable legislation, including the Spam Act 2003 (Cth).

We accept no responsibility for the misuse of communication features.


7. Subscription and Billing

- Services are provided on a recurring monthly subscription basis

- A 10-day free trial may be offered at our discretion

- Clients may cancel their subscription at any time

Cancellation will take effect at the conclusion of the applicable billing period, unless otherwise specified.


8. Refunds

Refunds are not provided except where required by law, including under the Australian Consumer Law.

We may, at our sole discretion, consider requests for refunds in exceptional circumstances.


9. Intellectual Property

All rights, title, and interest in and to the platform, systems, and underlying technology remain vested in Instructors Office.

Clients retain ownership of any data they provide.


10. Third-Party Services

Our services may depend on third-party systems and infrastructure.

We are not responsible for any delay, disruption, or failure arising from such third-party services.


11. Service Availability

While we endeavour to maintain reliable service delivery, we do not warrant uninterrupted or error-free operation, nor do we guarantee specific response times or system availability.


12. Limitation of Liability

To the maximum extent permitted by law, we exclude all liability for:

- Indirect, incidental, special, or consequential loss

- Loss of revenue, profit, business opportunity, or anticipated savings

- Any reliance placed on AI-generated outputs

Our total aggregate liability is limited to the amount paid by the client for the services in the 30 days immediately preceding the event giving rise to the claim.


13. Indemnity

Clients agree to indemnify, defend, and hold harmless Instructors Office from and against any claims, losses, damages, liabilities, or expenses arising out of or in connection with:

Any breach of these Terms

Failure to obtain required consents or comply with applicable laws


14. Suspension and Termination

We reserve the right to suspend or terminate access to the services where:

- These Terms are breached

- The services are used in a manner that is unlawful or inconsistent with their intended purpose


15. Variation of Terms

We may amend these Terms from time to time.

Continued use of the services following any amendment constitutes acceptance of the revised Terms.


16. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia.


17. Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms, the parties agree to first engage in good faith negotiations with a view to resolving the dispute promptly and amicably prior to commencing formal legal proceedings.
